This Privacy Policy is made by Imersive.io Private Limited incorporated in India and having its office at Ground Floor, New No 9, Old No 4/16, Casurina Drive, Kapaleeswarar Nagar, Neelangarai, Chennai, Chennai, Tamil Nadu, 600115 and its affiliates) (referred to as “Imersive”, "we", "us," or "our" hereafter) which operates, maintains, and controls the website, application or tool to which this Privacy Policy is linked (referred to as the “Site” hereafter).

At Imersive, we value your privacy and the importance of safeguarding your data. This Privacy Policy explains how we collect, record, and use the information you provide.

 

1.       SCOPE AND APPLICATION

1.1.    This Privacy Policy applies to all persons who visit the Site and/or provide their data to be processed in the Site or uses the services provided by Imersive through the Site (hereinafter referred to as “Services”)

1.2.    We will only use your personal information in the manner described in this Privacy Policy. Your continued use of the Site and our services constitutes your agreement to this Privacy Policy and any future revisions.

1.3.    By visiting and/or using our Site or providing your information, you agree to this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not provide us with any information or continue to visit or use the Site.

 

 

2.      DATA COLLECTION AND PURPOSE

We may collect and process information from the merchants who have engaged our services and from the individuals accessing our Site.

2.1.    Information we collect from Merchants:

To enable your use of the Services, we may collect:

(i)      Non-personal information such as store name, brands, domain address, product names, product images, product descriptions, specifications prices, inventory levels, URLs and associated data for the purpose of offering our Services, personalizing and managing your account,

(ii)    Account name and credentials in order to identify and authenticate your use of the Site

(iii)  Contact Information such as Contact name, Email Address, and phone numbers of Store Owners and/or authorized persons to communicate with you in respect of the Services, address queries, send marketing messages.

(iv)  IP Address or other unique identifiers to identify problems with the computer server and to administer our Site(s).

2.2.    Information we collect from the buyers visiting the 3D store:

If you are buyers accessing our tools, we commit that we will not sell your information to any third parties or use it for any marketing purposes. Our access and use of your information will be limited to the following:

(i)      Purchase Transaction Information: When our Site or the 3D store is linked to another e-commerce platform, the platform may provide us access to name, email address, phone number, physical address and geolocation, if the purchase transaction is completed. This data is maintained for verification and records purposes only and as per the terms of the platform’s privacy policy.

(ii)    IP Address and browser information: We may also collect the IP Address or other unique device identifiers, including your browser and operating system to identify problems, with computer server, to administer our Site(s). Your IP address is used to help identify you but contains no other personal information about you.

2.3.    Information we collect from buyers using our Virtual Features:

 

Please refer to Virtual Sizing, Fitting and Try-on Privacy Notice available at https://legal.imersive.io/jul2025/privacynotice.html   if you are a buyer using any of those features for measuring you through your device camera, ascertaining your size or for virtual try-on stimulations.

2.4.    Cookies

In order to give you the best experience, our website uses cookies and similar technologies for performance, analytics, and to help the website function. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. Cookies can be disabled or controlled by setting a preference within your web browser or on your Device. If you choose to disable cookies or flash cookies on your Device, some features of the Site may not function properly or may not be able to customize the delivery of information to you. Imersive cannot control the use of cookies (or the resulting information) by third parties, and use of third-party cookies is not covered by our Privacy Policy.

We may also use Browser Local storage to store opaque user identification information that helps our application identify the user within our system.

2.5.    Other Purposes for which we may use the data:

Where required by law or our legitimate business needs, we may use your data: (i) To operate, provide, and improve our Site and services. (ii) To contact you, respond to inquiries, monitor usage, and enhance offerings related to your account. (iii) For security, recordkeeping, reporting, enforcing policies, protecting rights and safety, and preventing or addressing illegal activities per applicable laws.

 

3.      DATA STORAGE

3.1.    Your data may be collected, stored, retained or processed anywhere and not necessarily within the county in which we are located, and you agree that you have no objection for the same.

3.2.    It may also be processed by staff outside the country in which you are based, who work for us or for one of our suppliers.

3.3.    We will not transfer the data to a country if the laws in India prohibit such transfers. These countries that we transfer your data to may not provide the same level of protection for Personal Data as within your country of residence.

3.4.    By submitting your personal data, you agree to this transfer, storing or processing. We will take reasonable steps to provide that your data is treated securely and in accordance with this privacy policy.

 

 

4.      DATA RETENTION

4.1.    We retain the personal information collected from our merchants for a period reasonably required for business purposes or for a period as required under any law.

4.2.    We retain the information collected from End-User for a period reasonably required for business purposes and/or for a period as permitted by law. The last three video footages submitted by an End-User is stored for a maximum period of 3 years in active database after which it is moved to backup/archives where it is retained for a further period of 4 years.

4.3.    Derived information such as anonymous body measurements, and brand specific sizing are proprietary to Imersive may be retained for longer period as it deems fit.

 

 

5.      SHARING OF INFORMATION WITH THIRD PARTIES

We will share the information collected on our Site to the third-party e-commerce/ merchant websites you have permitted to us to share the information.

We do not share your information to any other third party without your consent, unless for the following parties, (i) Our group companies who may also use your information for the purposes set out above, (ii) Vendors and service providers to perform services on our behalf, (iii) Government and public authorities in order to comply with applicable law, regulation, legal process, government request, including to meet national security requirements, (iv) We may share information with any successor to all or part of our business.

 

 

6.      CHILDREN’S DATA

6.1.    Our Site is not directed towards minors. We do not knowingly collect Personal Data from any individual below the age of 18 years.

6.2.    If a parent or legal guardian becomes aware that his or her child has provided his/ her Information on the Site(s) without their consent, he or she shall contact us for the deletion of such Information.

6.3.    In the event, where in contravention to the Privacy Policy and Terms of Use, a person below the age of 18 uses the services, we shall not be held liable or responsible for any damage or injury suffered by such person.

6.4.    If you believe that a child under 18 years has provided personal information to us, please write to the Grievance Redressal Officer with the details, and we will take the necessary steps to delete the information we hold about that child.

 

 

7.      YOUR RIGHTS

 

7.1.    If the data protection laws applicable to you provide the following rights, you can exercise the same by contacting us.

(i)                  Right to obtain a copy of your personal information

(ii)                Right to correct, complete or update inaccurate personal information

(iii)              Right to withdraw your consent for processing the information

(iv)              Right to erase your information in limited circumstances where it is no longer necessary in relation to the purpose for which it was collected or processed.

(v)                Right to nominate any other person to enforce your rights in the event of death or incapacity.

7.2.    To exercise these rights, you may contact the Grievance Officer in the manner provided at the end of this Policy. Please note that if you withdraw your consent for the processing of your data or revoke the permission to access your data, we might not be able to provide you with some or all services you requested or in the form intended to be provided to you.

 

8.      INFORMATION FOR USERS OUTSIDE THE INDIAN JURISDICTION

8.1.    If you are visiting our Site from outside of India, please be aware that information we obtain from you will be processed in the said or other jurisdictions. By using the sites, you agree that any personal information which you provide will be treated in accordant with the laws of India.

8.2.    In furtherance, you acknowledge and consent to the international transfer and processing of your personal data as described in this Site Privacy Policy.

8.3.    Please be aware that the data protection laws and regulations that apply to your personal data transferred may be different from the laws in your country of residence.

 

9.      THIRD PARTY WEBSITES

9.1.    Our Site may contain may include and link to features and services (including social applications like Facebook, Twitter, LinkedIn) that are provided by a third party. If you use these features and services, please understand that the third parties that operate them may collect information from you which will be used in accordance with their own privacy policy and terms of use, which may differ from ours.

9.2.      We have no responsibility or control over any linked websites or their privacy policies or the manner in which they collect, use or disclose your personally identifiable information.

 

10.   SECURITY MEASURES

10.1.                     We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your information.

10.2.  Unfortunately, transmission of information via the internet is not always secure and we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

10.3.  As mentioned above, once we receive your transmission of information, we make commercially reasonable efforts to ensure its security in our systems. However, please note we cannot guarantee the security of your information in our system and that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

10.4.  The Personal Information we store is encrypted using encryption standards or algorithms that conform with national and international standards, which as of date of updating this Privacy Policy is symmetric key sizes of 256 bits and asymmetric key sizes of 1024 or 2048 bits.

 

11.    INDEMNITY

You agree to indemnify and hold harmless Imersive, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) for your violation of this Privacy Policy, violation of any rights of a third party, or any unauthorized use of our services.

 

12.     LIMITATION OF LIABILITY

To the fullest extent permitted by law, Imersive and its affiliates shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, use, or data, resulting from your use of our services. In no event shall Imersive's total liability exceed the amount paid by you to Imersive, if any, for accessing our services.

 

13.   CHANGES TO THE PRIVACY POLICY

13.1.                  We retain the right to amend this Privacy Policy from time to time, for instance when we update the functionality of the Website or when there are regulatory changes.

13.2.                  We will use commercially reasonable efforts to generally notify all users of any material changes to this Privacy Policy, such as through a notice on the website. However, as a user of the website, you should look at this Privacy Policy regularly to check for such changes.

13.3.                  Your continued access or use of the website after the date of the new Privacy Policy constitutes your acceptance of the new Privacy Policy. If you do not agree to the new Privacy Policy, you must stop accessing and/or using the Site.

13.4.                  You hereby acknowledge that any collection, storage, processing or other use of Your Information shall be governed by the Privacy Policy as applicable at the time of such collection, storage, processing or other use.
